Terms of Service - The Legacy Check

1. Acceptance of terms
By using The Legacy Check ("this tool," "this site"), you agree to these Terms of Service. If you don't agree, please don't use the tool. This tool is provided by Online Tax Solutions Group LLC (doing business as Tax Sherpa) ("we," "us," "our").
2. What this tool is - and isn't
The Legacy Check is a free, educational estimation tool. You enter a child's age; the tool returns a list of example jobs, a benchmark hourly wage sourced from published national wage data (details below), and an estimated business tax deduction and tax savings based on a flat, generalized assumption about hours worked and tax rate.
This tool does not provide tax, legal, accounting, or financial advice. The numbers it produces are illustrative estimates based on general assumptions, not a calculation of your specific tax situation, and they are not a substitute for professional advice tailored to your business, your state, your entity structure, and your family's actual circumstances.
3. Key assumptions behind every estimate
To keep this tool simple and free, every result is calculated using the following fixed, generalized assumptions, which will not match every family's actual situation:
- Hours worked: every job assumes a child works 10 hours per week during the school year (9 months) and 20 hours per week during summer (3 months) - 650 hours per year total. Your actual results will vary based on your child's real schedule.
- Hourly wage: each job's wage is benchmarked against published U.S. Bureau of Labor Statistics national wage data (or, where no government data exists for a specific task, a general market-rate observation) for a comparable adult occupation. These are reference points, not a guarantee that this specific wage is defensible for your business without further review.
- Tax savings: estimated at a flat 32% of the calculated deduction, a general approximation and not a calculation of your actual marginal or effective tax rate.
- Federal law only: the age and hour framework referenced by this tool is based on federal law (the Fair Labor Standards Act's exemption for children employed in a business wholly owned by their parents). State-level tax and labor treatment can vary - some states do not fully follow the federal exempt treatment, and the details can depend on how your business is legally structured (for example, some states treat wages paid directly by a parent differently than wages paid through an LLC for state unemployment-tax purposes). This tool does not account for state-specific variation.
4. Professional assistance required
A real tax deduction requires more than a calculation. To convert the estimate this tool produces into an actual, defensible business deduction, you need: a formally documented employment relationship, a real job description, accurate timekeeping, wages actually paid and reported correctly, and a setup reviewed by a qualified tax professional before you run payroll. Using this tool is not a substitute for that process, and the estimate it produces should not be relied upon or acted upon without professional review. We recommend booking a consultation with Tax Sherpa or another qualified tax professional before implementing anything based on this tool's output.
5. No data retention
This tool does not collect, save, or store the age or any other information you enter - see our Privacy Policy for details. Because nothing is saved, we have no record of your specific results and cannot retrieve them for you after your session ends.
6. No warranty
This tool is provided "as is," without any warranty of any kind, express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose. Wage benchmarks and calculations may become outdated as government data is updated, tax law changes, or our assumptions are revised.
7. Limitation of liability
To the fullest extent permitted by law, Online Tax Solutions Group LLC (doing business as Tax Sherpa) is not liable for any decisions made, or actions taken or not taken, based on this tool's output, and is not liable for any damages arising from your use of, or inability to use, this tool.
8. Changes to these terms
We may update these Terms of Service at any time, for example to reflect a change in the underlying wage data or assumptions. The "Last updated" date above reflects the most recent revision. Continued use of the tool after a change constitutes acceptance of the updated terms.
9. Governing law
These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
